BETTERING STATUTORY SICK PAY

  • End minimum earning threshold for SSP and End Lower Earnings Level in National Insurance system, so providing
    Statutory sick pay (SSP) from first £1 of lowest wage.

  • Pay Statutory Sick Pay (SSP) at
  • 100 per cent of pay for first
    6 weeks,
  • 80 per cent for next 20 weeks and
  • 70 per cent  of employee's salary
  • for period of up to 78 weeks.

What is Statutory Sick Pay?

  • You get Statutory Sick Pay (SSP) if you’re too ill to work. It’s paid by your employer for up to 28 weeks.


  • You cannot get less than the statutory amount.


  • You can get more if your company has a sick pay scheme (or ‘occupational scheme’) - check your employment contract.


  • You can get SSP from the fourth day you’re off sick.


  • If you’re eligible, you’ll be paid SSP for all the days you’re off sick that you normally would have worked, except for the first 3.




WHO DOES NOT GET SSP

You can’t get SSP if you:


  • are self-employed
  • had SSP for 28 weeks and the 28 weeks ended within the last 8 weeks
  • were paid Employment and Support Allowance (ESA) in the last 12 weeks
  • are in the armed forces
  • are in legal custody, detained either by the police or in prison
  • have an agricultural workers contract from before 1 October 2013



If you’re on maternity leave

You cannot get paid SSP if you’re getting Statutory Maternity Pay (SMP) or
Maternity Allowance (MA).

According to research by The Exeter, published in its Health and Financial Fears Report 2023:


  • 19 per cent of workers are not entitled to any employer sick pay, and
  • almost half (49 per cent) would received support for no longer than three months.
  • Notably, more women than men reported that they did not receive any employer sick pay.


  • Statutory sick pay currently stands at £109.40 per week.
